Manufacturers and deployers of robots in Europe face an increasingly complex regulatory landscape as multiple EU frameworks converge over the next two years.
The Digital Omnibus Shift
The EU’s Digital Omnibus on AI is reshaping the regulatory framework for robotics and physical AI. Rather than creating parallel compliance regimes, the EU is moving toward a sector-specific approach where AI requirements for industrial robotics will increasingly be integrated into existing product legislation, particularly the Machinery Regulation.
According to legal analysis, this represents “a structural shift towards a sector-led compliance model for Physical AI, requiring manufacturers to align AI, cybersecurity, product safety, and post-market compliance strategies across multiple regulatory frameworks”.
Key Compliance Dates
Deployers of humanoid robots in Europe face a series of critical deadlines:
- September 11, 2026: Cyber Resilience Act vulnerability reporting obligations take effect, requiring notification of actively exploited flaws within 24 hours
- November 2, 2026: AI Act transparency obligations for all deployers
- January 20, 2027: Machinery Regulation 2023/1230 becomes mandatory, replacing the existing Machinery Directive
- December 11, 2027: Full Cyber Resilience Act product compliance required
- December 2027 (provisional): AI Act high-risk obligations for Annex III use cases
- August 2028 (provisional): AI Act requirements for AI acting as safety components
The Compliance Gap
A significant challenge for the industry is that fewer than 15% of commercial humanoids hold a complete industrial CE certification file in 2026. The useful question for buyers is not “is it approved” but “what evidence exists, what is missing, and who completes the file”.
Humanoid robots are not automatically classified as “high-risk” under the AI Act. They become high-risk only through use—if their AI performs biometrics, surveillance, or decisions affecting people, or if the AI is a safety component of the machine.
